The Official State Gazette of 2 March 2022 published the Resolution of 28 February 2022, of the Secretariat of State for Civil Service, laying down management instructions for the partial retirement of workers under the IV Single Convention of the General Administration of the State.
The signing of the IV Single Convention for the Labour Force of the General Government of the State has meant the possibility of partial retirement for the labour force subject to the Single Convention under the terms of the law.
In order to comply with this forecast, the Joint Commission of the Fourth Single Convention set up a working party which has carried out the analysis and study of parical retirement within the scope of the Single Convention and the establishment of conditions and criteria, after negotiation with the trade union organisations, which were approved by the Joint Commission on 18 January 2022.
The implementation of this figure suggests that management instructions should be issued to ensure that the age of access to ordinary retirement is gradually and progressively reduced, avoiding a sudden break between working life and retirement, as pointed out by Royal Decree 1131/2002 of 31 October, regulating the social security of part-time workers, as well as partial retirement.
It is also necessary to provide the procedure with sufficient agility and coordination, taking into account the various administrative bodies acting, and in the case of early partial retirement of the need to enter into a relay contract with another unemployed person in accordance with the principles of access to public employment.
