The net cost of providing the universal service must be approved annually by the National Commission on Markets and Competition (CNMC) on the basis of the methodology established by it in terms of both cost allocation and revenue allocation, including non-monetary benefits, and shall be based on objective, transparent, non-discriminatory and proportionate procedures and criteria.
Where CNMC has assessed a net cost, it shall determine whether the net cost entails an unjustified burden on the designated operator. Where this is the case, it shall determine the operators required to finance it and the quotas for each of them, in proportion to their turnover in the market for the provision of electronic communications services.
