Plural audiovisual communication.

Respect for the fundamental rights of the people .
- Audiovisual communication can never incite hatred or discrimination based on gender or any personal or social circumstance.
- It must be respectful of human dignity and constitutional values.
- Special attention to the eradication of behaviours favouring situations of inequality of women.
- It must respect people’s honour, privacy and self-image.
- You must guarantee the rights of rectification and reply.
Respect for the rights of minors.
- Your image and voice cannot be used without your consent or that of your legal representative.
- The dissemination of the name, image or other data that allow its identification in the context of criminal acts or broadcasts that discuss its guardianship or filiation is prohibited.
- It prohibits the open broadcasting of content that could seriously harm the physical, mental or moral development of minors and, in particular, programs that include pornography or gratuitous violence scenes. Conditional access must make parental control possible.
- Those other contents that may be harmful to the physical, mental or moral development of minors may only be broadcast between 22 and 6 hours, always preceded by an acoustic and visual warning. The visual indicator must be maintained throughout the programme in which such content is included.
- Bands of reinforced protection: between 8 and 9 o’clock and between 17 and 20 o’clock on working days, and between 9 and 12 o’clock on Saturdays, Sundays and public holidays. In these slots you cannot issue content qualified as not recommended for children under 13 years of age.

- Commercial communications must not cause moral or physical harm to minors. The following limitations are established:

- They should not exploit the special relationship of trust that minors place in their parents, teachers, or other people.

- Commercial communications about products specially intended for minors, such as toys, must not mislead the characteristics of the same, nor about their safety, nor about the capacity and skills necessary in the minor to use them without causing harm to himself or to third parties.

Transparent audiovisual communication.
- Right to know the identity of the provider of the audiovisual communication service, as well as the companies that are part of its group and its shareholding. Identification on a website.
- Right to know the television programming with a minimum of three days in advance.
- The programming shall be made known by means of an Electronic Programme Guide (EPG), the basic free content of which shall also be available on an Internet programming information service located on a web page.
- The programming may only be altered by events beyond the control of the audiovisual service provider or by events of interest for information or live programming.
- The public authorities and audiovisual media service providers must contribute to the media literacy of citizens.
- Commercial communication must be clearly differentiated from other audiovisual content.
- In the broadcast of those forms of advertising other than television advertisements which, due to the characteristics of their broadcast, could confuse the viewer about their advertising character, transparency with the indication ‘advertising’ must be permanently and clearly legible.
Obligations of accessibility.
- The information on the identity of the service provider and on the programming contained in Internet pages, EPG or other means of communication of the service provider must be accessible to persons with disabilities.
- Television audiovisual communication in open channels and state or regional coverage (a transitional regime is established until 31/12/2013):
- 75% of the subtitled programs.
