Calculation of the rate
According to the General Law of Telecommunications, for the fixing of the amount to be satisfied by the obligated subjects, the market value of the use of the reserved frequency and the profitability that the beneficiary could obtain from it must be taken into account.
For the determination of the aforementioned market value and the possible profitability obtained by the beneficiary of the reserve, the following parameters are taken into consideration, among others:
- The degree of use and congestion of the different bands and in the different geographical areas.
- The type of service for which the reservation is intended to be used and, in particular, if it is accompanied by the public service obligations set out in Title III of the General Law on Telecommunications.
- The band or subband of the spectrum that is reserved.
- The equipment and technology used.
- The economic value derived from the use or exploitation of the reserved public domain.
Radio reserve unit and modality codes
The calculation of the rate for each reserve is done by multiplying the number of radio reserve units (NURR) by the value assigned to each unit (VURR).
The radio reserve unit (URR) is a conventional measurement pattern, referred to the reserve, over the period of one year, of a bandwidth of 1 KHz over an area of 1 Km2.
The value of the radio reserve unit (VURR) varies from one reserve to another and depends on the parameters that serve as the basis for the calculation of market value and profitability. To take into account these variations, the so-called “modality codes” are created, to which are associated coefficients (C1, C2, C3, C4 and C5) that collect the effect of said parameters. The mode codes are four-digit numeric codes.
In the granting resolution of each enabling title, both the NURR and the modality code corresponding to the reservation must be reflected, since from this code the coefficients that serve for the calculation of the VURR are recovered.
Formula for calculation and coefficients
The formula for the calculation, the coefficients (C1, C2, C3, C4 and C5) associated with each modality code and the minimum amount to be entered are fixed each year in the Law of General Budgets of the State.
The formula and the values of the applicable coefficients will be those included in the General State Budget Law in force at the time of the accrual of the corresponding rate.
The application of the formula, together with the identification of the corresponding modality code, also allows the amount of the fee to be estimated prior to the request for a reservation.
