Telecommunications fees

The precise management for the granting of certain concessions and authorizations, registration, issuance of certifications, performance of mandatory inspection actions, issuance of technical opinions and the performance of examinations shall be entitled to the levy of the compensation fees for the cost of the necessary procedures and actions, in accordance with the provisions of the following paragraphs.

the levying of the fee constitutes the precise management by the Administration for the issuance of registration certificates; for the submission of a technical project of common telecommunications infrastructures and of the certificate or installation bulletin that protects the common telecommunications infrastructures inside buildings; for compliance with the technical specifications of telecommunications equipment and appliances; as well as the issuance of technical opinions evaluating the conformity of these equipment and appliances; the inscriptions in the registry of telecommunications installation companies; the inspection or technical checking actions that, on a mandatory basis, are established in this Law or in other provisions with legal status or the submission of procedures issued by the competent technical authorities to carry out inspections;

The fee shall be payable, depending on the circumstances, to the natural or legal person who requests the corresponding certification or technical evaluation opinion; who submits to the registry of telecommunications installation companies the corresponding responsible declaration; who requests a certification of presentation of the technical project of common telecommunications infrastructures, the reconsideration report, the installation bulletin and the test protocol and, where appropriate, the end-of-works certificate and the annexes; the person to whom it is appropriate to carry out the mandatory inspection actions or request the processing or concessions of demanials for the private use of the public radio domain or the processing of general or individual authorizations, of special use, for the purposes of obtaining the technical title.

The amount of the fee shall be set forth in the State General Budget Act. The fee will accrue at the time of the corresponding request. The rate performance will be entered into the Public Treasury. By royal decree the form of liquidation of the rate will be established.

The performance of tests or tests to check compliance with technical specifications will be considered as a public price when they can be carried out by the interested party, optionally, in centers dependent on the Administration of any Member State of the European Union, of the Spanish Administration or in private or non-private centers, when such tests are requested by the interested party voluntarily without being obliged to do so by the regulations in force.

The fee for processing individual authorisations for special use in the public radio domain shall be waived for those applicants for such authorisations who are 65 years of age in the year in which they make the application, or who have complied with them previously, as well as for beneficiaries of a public pension or who have a recognised degree of disability equal to or greater than 33 per 100.

Law 11/2022, of June 28, General of Telecommunications, establishes new amounts for the telecommunications fees that are collected through the 790 model, until the amounts of the fee foreseen in section 4 of Annex I are established by the Law of General Budgets of the State.
