The General Telecommunications Law establishes in its article 50.7 the following:
[…] The Ministry of Economic Affairs and Digital Transformation shall adopt recommendations for the elaboration by the competent public administrations of the rules or instruments contemplated in this section, which may contain models of municipal ordinances elaborated in conjunction with the association of local entities at the state level with greater implementation. In the case of municipalities, the request for a report referred to in paragraph 2 of this article may be replaced by the submission to the Ministry of Economic Affairs and Digital Transformation of the draft instrument accompanied by the declaration of the mayor of the municipality accrediting compliance with these recommendations. […].
From this text, it follows that the General Secretariat for Telecommunications and Management of Audiovisual Communication Services may publish, in the manner described above:
- A series of recommendations for the development of urban planning standards or instruments, related to the requirements of the deployment of electronic communications network infrastructure.
- Models of a standard ordinance that allow the competent Public Administrations that deem it appropriate to develop their telecommunications ordinance in order to order the installation and deployment of such infrastructures without impairing compliance with the Law and the necessary technical conditions.
This section will deal with the models of the standard ordinance mentioned in the previous paragraph, once they have been definitively drafted by the General Secretariat of Telecommunications and Management of Audiovisual Communication Services.
