Article 51 of the General Law on Telecommunications states that when urbanization projects are undertaken, the technical urbanization project must provide for the installation of civil works infrastructure to facilitate the deployment of public electronic communications networks, which may also include passive network elements and equipment. According to the General Telecommunications Law, the infrastructures that are installed to facilitate the deployment of the public electronic communications networks according to the previous paragraph will be part of the whole resulting from the urbanization works and will be integrated into the municipal public domain. The public administration holding such a public domain shall make such infrastructures available to the operators concerned on an equal, transparent and non-discriminatory basis.
Although it is true that the details of the aforementioned facilities are pending approval by Royal Decree, it should be noted that such infrastructures must be provided in the urban planning instruments approved by the different Public Administrations.
