Data Intermediation and Data Altruism Services (DGA regulation)
On June 3, 2022, the Official Journal of the Union published the Regulation (EU) 2022/868 of the European Parliament and of the Council of 30 May 2022 on European data governance and amending Regulation (EU) 2018/1724 (DGA Regulation).
The Regulation establishes, among others, a notification and supervision framework for the provision of data intermediation services and a framework for the voluntary registration in a register of the entities that collect and process data ceded for altruistic purposes.
In this way, the regulation aims to promote the exchange of data between sectors and between Member States of the Union by strengthening confidence in data exchanges, in order to boost the internal data market and promote a data economy and society that benefits citizens and businesses.
The provisions of the Regulation apply to providers of data intermediation services and recognised data management organisations for altruistic purposes established in the Union, as well as to those that are not established in the Union, but offer their data intermediation or data management services for altruistic purposes in the Union.
The Regulation is of application from September 24, 2023. However, data intermediation service providers already providing such services by 23 June 2022 shall comply with the obligations of Chapter III of the Regulation by 24 September 2025.
