Television Operators who have the editorial responsibility for television channels and whose programming includes feature films of current production, that is, with an age of less than seven years from their date of production, must allocate at least, every year, five percent of the total amount of income earned during the previous year, according to their operating account, to the advance financing of the production of feature films and short films and films for European television, including the assumptions contemplated in article 5.1 of the Law on the Promotion and Promotion of Cinematography and the Audiovisual Sector, in accordance with the provisions of article 2 of the Regulation approved by Article 2 of the Royal Decree. In addition, sixty percent of the previous investment should be allocated to the anticipated financing of the production of works in any of the official languages in Spain.
As of May 1, 2010, Law 7/2010, of March 31, General of the Audiovisual Communication, in Title II, Chapter I, Article 5 establishes that the providers of the television audiovisual communication service of state or regional coverage must pay annually to the advance financing of the European production of cinematographic films, films and television series, as well as documentaries and films and animation series with 5% of the revenues accrued in the previous year by their channels that broadcast these products, when they are less than 7 years old from their date of production. This obligation is raised to 6% in the case of providers of public ownership. In addition, with the exception of providers that broadcast thematic channels, at least 60% of the anticipated investment must be in cinematographic films, although for public operators it will be 75%, being at least 50% of the total investment of the annual computation in works of independent producers. As in the previous regulations, 60% of the previous investment must be destined to works in any of the official languages in Spain.
Providers of electronic communication services that broadcast television channels and providers of program catalogue services are also subject to the obligation.
