The private use of the public radio domain is made through the exploitation, exclusively or by a limited number of users, of certain frequencies in a physical field of application.
The private use of the spectrum requires an individualized enabling degree, granted by the Secretary of State for Telecommunications and Digital Infrastructures, enabling degree that may take the form of individual authorization, general authorization, administrative concession or demanial affectation.
The individual authorization enables the use of frequencies intended for the coverage of the owner’s own radio needs, (self-provision of services). When the holder is a Public Administration, the required title is that of affectacion demanial.
The general authorization entitles the operators of certain radiocommunication services, established through ministerial orders, to the use of the radio spectrum.
The administrative concession is mandatory in cases of use of the spectrum by operators for the provision of services to third parties (public services).
