Electronic procedures
According to the Law 39/2015, of 1 October, on the Common Administrative Procedure of Public Administrations, and Royal Decree 123/2017, of 24 Februarywhich approves the Regulation on the use of the public radio domain, the processing of radio spectrum procedures, as well as the relationship with the competent bodies of the Ministry of Digital Transformation in this regard, must be carried out compulsorily by electronic means.
Access to the electronic procedures of the General Subdirectorate of Radio Spectrum Planning and Management
The procedures of the Sub-Directorate General for Radio Spectrum Planning and Management are available at the Ministry’s electronic headquarters. They can be accessed by searching for the literal “radio spectrum” through the search engine found in the “Electronic Procedures and Services” section of the headquarters. A list will appear with all the procedures related to the public radio domain, grouped in “tabs” by services:
- Radio amateurs
- Radiodetermination, Satellite, Fixed Point-to-Multipoint Service and others
- Broadcasting
- Fixed Broadband Service Radio Networks
- Narrowband Mobile/Fixed Band Radio Networks
- Space Services
- Processing of electronic communications stations in harmonized bands
- Administrative procedures on qualifying titles for the private use of the radio spectrum
Through each of these forms you can access the corresponding application forms, as well as manuals, instructions, declaration models, etc. necessary for its completion. Within each tab you can find both procedures related to the application of enabling titles for use of the radio spectrum and other administrative procedures related to rectification, withdrawal, etc. of applications already submitted.
Access with electronic certificate
To access the application forms, either by the holder or his duly authorized representative, it is necessary to have a recognized electronic certificate, issued by any of the certifying companies that are recognized on the web of the Ministry.
In case of access by the holder, it must do so with its electronic certificate of natural person in case of being a natural person, or with certificate of natural person with representation of legal person in case of a legal person. If, on the other hand, a representative of the holder accesses, he may do so with his certificate of natural person attaching the powers of representation granted by the holder. In the latter case, if the person submitting the application is listed as the agent of the holder in the Electronic Registry of Authorizations (REA), it would be sufficient to indicate this fact and it would not be necessary to attach the corresponding powers of representation.
Access to the procedures for electronic communications services in harmonised bands and broadcasting services does not require an electronic certificate as it is a closed user group.
Electronic notifications of the procedure
In accordance with the provisions of article 43.1 of Law 39/2015, of 1 October, on the Common Administrative Procedure of the Public Administrations, the notifications corresponding to the request will be made by electronic means through attendance of the interested party or his duly identified representative at the electronic headquarters of the Ministry. The application form will indicate an email address where a notice will be sent informing of the availability of notifications related to the application at the electronic headquarters. This notice does not constitute in any case the notification.
In any case, the holder and, in addition, the natural person who has made the request (the presenter) will be able to access the notifications by appearance in the Ministry’s electronic headquarters.
It should be noted that, according to article 43.2 of Law 39/2015, the electronic notification will be understood rejected when ten calendar days have elapsed since the notification was made available in the electronic headquarters of the Ministry without access to its content. This implies that the procedure will be carried out and the procedure will be continued. In any case, the content of the notification can always be accessed for your consultation.
