The Government opens a prior public consultation to transpose the new audiovisual directive

The Ministry of Economy and Enterprise has launched a public consultation to seek the opinion of audiovisual sector agents and other stakeholders on the transposition of Directive (EU) 2018/1808 of Parliament and of the Council of 14 November 2018. The transposition amends Directive 2010/13/EU on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of audiovisual media services (Audiovisual Media Services Directive) in the light of changing market realities.
The transposition of the new Community Directive will entail the updating of the national regulation of the audiovisual sector. Audiovisual agents and other interested parties will be able to make contributions until 22 February 2019 21 January 2019.- The Ministry of Economy and Enterprise has launched a public consultation to obtain the opinion of audiovisual agents and other interested parties on the transposition of Directive (EU) 2018/1808 of Parliament and of the Council of 14 November 2018. The transposition amends Directive 2010/13/EU on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of audiovisual media services (Audiovisual Media Services Directive) in the light of changing market realities. The entry into force of this Directive came 20 days after its publication in the Official Journal of the European Union and the Member States have 21 months to carry out its transposition. Among the main innovations introduced by the new audiovisual directive are the strengthening of the protection of viewers in general and minors in particular by extending the scope of the regulation to services for the exchange of videos generated by users through platforms and social networks, provided that they offer services equivalent to these. In addition, progress is being made in the harmonization of the regulation of linear audiovisual services, video-on-demand services and video exchange services generated by users through platforms. The process of transposition of the directive into the national legislative framework, which will involve amending Law 7/2010, of March 31, General of Audiovisual Communication, will be coordinated by the Secretary of State for Digital Advancement. The objective of the prior public consultation, which is structured in 25 questions, is to have the initial contributions that can be provided by agents of the audiovisual sector, Public Administrations, agents of other sectors linked to the audiovisual, consumer and user associations and society as a whole, on the transposition of Community regulations into the Spanish legal system.
