The Council of Ministers today approved the Royal Decree amending Royal Decree 188/2016, of 6 May, which establishes the requirements for the marketing, commissioning and use of radio equipment, and regulates the procedure for the conformity assessment, market surveillance and sanctioning regime of telecommunication equipment.
The new Royal Decree transposes Spanish regulations, —as far as the introduction into the market of radio equipment is concerned—, Directive (EU) 2024/2749 and Regulation (EU) 2024/2747 that were approved in 2024 in order to ensure that a crisis, such as that caused by the COVID pandemic, does not alter the normal functioning of the internal market of the European Union; it does not affect the free movement of goods, services and people; and the availability of goods and services of critical importance for citizens is guaranteed.
The Royal Decree approved today establishes emergency procedures for the introduction into the market of radio equipment that will be applicable if the emergency mode of the internal market is activated and provided that this specific equipment has been designated as relevant to crises.
The text also provides for conformity assessment bodies to give priority to equipment that is relevant in this crisis situation and to market surveillance and mutual assistance activities between EU states.
In the event of disturbances in the internal market, the State Secretariat for Telecommunications and Digital Infrastructure, as the competent authority, may authorise, on an exceptional and temporary basis, the placing on the market of radio equipment which has not been subject to the usual conformity assessment procedures. Consequently, these products will not be able to carry the CE marking.
This facilitates the work of radio equipment manufacturers by enabling them to quickly bring equipment onto the market before the completion of conformity assessment procedures, thereby enabling the accelerated and exceptional introduction into the market to contribute to the rapid increase in the supply of necessary equipment.
