The Ministry of Economic Affairs, through the Secretary of State for Telecommunications and Digital Infrastructures, has launched a public consultation on the new regulation on audiovisual commercial communications, which brings the regulation in this area into line with the current legal framework after the entry into force of the General Law on Audiovisual Communication.
The consultation is aimed at getting to know the opinion of the people and entities potentially affected by the new Regulation, which includes the legislative changes introduced in the law, which should guarantee both the right of audiovisual media service providers to disseminate commercial communications in a secure and flexible legal framework, and the protection of users, especially minors.
This regulatory development of audiovisual commercial content will reach all providers of the audiovisual communication service: television, radio, video exchange through platform and users of special relevance who use these channels to market, sell and organize commercial communications.
In accordance with the new General Audiovisual Communication Law, which incorporates the European Audiovisual Communication Directive into the legal system, the quantitative limits for the broadcasting of commercial content on linear television services are relaxed.
The updating of the regulation on audiovisual commercial communications is part of the development of the Law that entered into force at the beginning of July and that is part of the reforms foreseen in the Recovery, Transformation and Resilience Plan.
