Penalties for non-compliance by national television operators (2005-2011)

These are the global data of the sanctions that the Ministry of Industry, Tourism and Trade has imposed on national television channels for breaches of the regulations of the audiovisual field: the law transposing the Television without Borders Directive, already repealed, and the General Law of Audiovisual Communication, in force since May 1, 2010.


These are the global data of the sanctions that the Ministry of Industry, Tourism and Trade has imposed on national television channels for breaches of the regulations of the audiovisual field: the law transposing the Television without Borders Directive, already repealed, and the General Law of Audiovisual Communication, in force since May 1, 2010.

The data are broken down by type of infringements, although some of the files opened during 2010 and those opened in 2011 are still being processed. These data will be updated as new sanctions are imposed.

In the analysis of the published data, it highlights that the infringements referred to the excesses of broadcasting advertising spaces represent in each year more than half of the sanctions imposed by all concepts.

During the period 2005-2011, the punitive actions regarding aspects also linked to advertising, such as their identification and placement or legality, the effect that their issuance may have on the integrity of audiovisual works that they interrupt and covert advertising, have been maintained on a continuous basis.

Another aspect of interest in the published data is in the actions aimed at safeguarding the rights of minors against advertising and programming. At this point, there was an increase in the number of cases opened in 2011.

Finally, the data also reflect the sanctions imposed by the programming changes without respecting the minimum time established (three days) and by the non-fulfilment of the obligation of television companies to finance European audiovisual works with 5% of their income.

The decrease in the amount of sanctions in 2011 is only apparent because 13 dossiers are still pending final resolution.
