The Government establishes the criteria that define the ‘influencers’ and regulates the use of a single charger for all devices
Users of special relevance (‘influencers’) are those who deposit more than 300,000 euros per year and who exceed one million followers on a user-generated video exchange platform or two million followers aggregated on several platforms. In addition, the Royal Decree of Commercialization of Radio Equipment is modified so that all chargers of electronic devices are USB type C from the end of the year.
The Council of Ministers, on the proposal of the Ministry for Digital Transformation and Public Service, has approved the Royal Decree that establishes for the first time the requirements to regulate ‘influencers’ to comply with the General Law of Audiovisual Communication, approved in 2022.
This regulation gives greater protection to consumers and greater legal certainty to these users, who have achieved a remarkable importance and significant economic volume in the platforms for the exchange of videos through which they disseminate their contents.
The Royal Decree defines “users of special relevance” (“influencers”) based on two simultaneous criteria. Firstly, the economic criterion, which requires these providers to have an annual income of more than 300,000 euros derived from all their audiovisual activity. Secondly, the audience criterion, which requires that they exceed one million followers in a single video exchange platform or two million followers in the global of their activity, and that they have published or shared 24 or more videos a year.
All influencers who meet both criteria must register, within two months, in the State Registry of Audiovisual Providers as users of special relevance.
From the moment of registration they will have to comply with the regulations on the protection of minors and advertising in the audiovisual field, such as identifying advertising spaces or not advertising tobacco, medicines or alcohol; that is, their obligations will be approved with those of other audiovisual agents.
Single charger required this year
In addition, the Council has approved the amendment of the Regulation on the marketing of radio equipment of Royal Decree 188/2026, of 6 May, so that all new electronic device chargers are USB type C.
Thus, from December 28, 2024, all chargers of mobile phones, tablets, cameras, headphones, speakers or portable video consoles, among others, must be of type C to offer greater comfort to the user, provide the possibility of acquiring these equipment without the charging device, and achieve a lower environmental impact with the reduction of electronic waste. For notebook computers, the same obligation will enter into force in April 2026.
5G Cybersecurity Schema
Finally, the Council of Ministers has given the green light to the Royal Decree regulating the National Network Security Scheme 5G, which is contemplated in the Royal Decree Law on Cybersecurity 5G. It is a standard that describes the procedures, certifications and security schemes that operators must carry out to comply with the obligations of management of cybersecurity risks 5G, especially in those facilities especially important for national security. It includes measures to mitigate these risks that operators have to carry out and diversification strategies.
Among the main innovations, it incorporates the creation of a 5G Operations Center, a pioneer in Europe, financed with funds from the PRTR (15 M€) in collaboration with the National Cryptological Center, with the following tasks:
