The Government brings to public consultation the Royal Decree of the National Forum of Emerging Companies that promotes the Law of Startups
The Ministry of Economic Affairs and Digital Transformation of the Government of Spain, through its Secretary of State for Digitalization and Artificial Intelligence, has opened the process of public hearing on the Royal Decree that creates and regulates the National Forum of Emerging Companies.
This organization has the objective of promoting innovative entrepreneurship, as well as proposing improvements oriented to the growth and integration of emerging companies in the community and world markets. Its creation was included in article 25 of Law 28/2022, of December 21, on the promotion of the ecosystem of emerging companies, known as the Law of Startups.
The objective of the hearing process is to make available to citizens an open participation space, through which the agents involved can examine the text that will determine the creation of the Forum. After the closing of the public hearing process, the final text of the Royal Decree will be published.
Consultative and collaborative body
The Forum, attached to the Ministry of Economic Affairs and Digital Transformation, through the Secretary of State for Digitalization and Artificial Intelligence, will be an interministerial collegiate body. It will be consultative and collaborative in nature between the Public Administrations, universities, public research bodies and technology centers, associations with the most representative associative base at the state and regional level, associations or corporations of intermediary professionals, emerging companies and those others that collaborate with them.
To ensure effective functioning, its structure will have an institutional plenary, and working groups, which will allow the specific issues raised to be addressed. In this way, it is intended to strengthen the mechanisms of participation among all the relevant parties, promoting that public policies and their implementation respond to the real needs of emerging companies.
Functions
The National Emerging Business Forum has the following functions:
- Analyze and debate public policies to promote innovative entrepreneurship, with the purpose of making recommendations on its orientation, promoting diversity, inclusion and other democratic values and principles.
- Promote the coordination of policies and measures related to innovative entrepreneurship carried out by the different competent bodies through the formulation of recommendations and the harmonization of criteria for the provision of services and implementation of support programs to emerging companies.
- Disseminate the policies and measures related to innovative entrepreneurship carried out by the different national, regional and local competent bodies.
- Identify good national and international practices in the field of innovative entrepreneurship, with special focus on the scaling of emerging companies, access to financing, internationalization and innovation, drawing up the relevant reports.
- Disseminate the policies of the EU, OECD and other international bodies in the field of innovative entrepreneurship and emerging companies.
- Act as an observatory of emerging companies analyzing the state, needs and trends of these companies, being able to carry out the studies that are considered necessary, hold workshops and events or develop informative materials.
- To encourage dialogue between the General Administration of the State and the public bodies linked or dependent on it with the agents of the Spanish innovative ecosystem, and may also make recommendations to those agents to promote innovative entrepreneurship.
- To know the execution and results of the multiannual program of aid to entrepreneurship based on innovation.
- Propose indicators of compliance with the objectives of Law 28/2022, of 21 December, for approval by the Government Delegated Commission for Economic Affairs; monitor the impact of the Law and its development regulations on the Spanish innovative ecosystem and prepare the mandatory and non-binding report for the continuous evaluation of the application of the Law, which is included in article 25.4 of the same.
Startups Law
La Law of Startups, under which the National Forum of Emerging Companies was born, seeks to respond to the main challenges faced by this type of companies, among which are the high risk they must assume due to their inherent innovative character, the difficulty of access to financing in the different phases of life of the company or the need to have highly qualified workers.
The measures contemplated by the Law of Startups, like the creation of the Forum, respond to the rapid transformation experienced by the economy in recent years, which is promoting the emergence of new companies that make innovation and the digital environment the basis for the creation of products and services of high added value.
Supporting and promoting this type of business is essential to improve the country’s competitiveness in a world in which the commitment to technology, digitalization and innovation is already an obligation.
