Madrid, December 27, 2024.-The Office of the Secretary of State for Civil Service, through the Office of the National Civil Service, and the Office of the Secretary of State for Social Rights, published in public hearing the draft Order establishing general criteria for the adaptation of means and times in the selective processes for the access to public employment of persons with disabilities. This regulation seeks to update and improve the conditions of participation in the competitions of this group, with the aim of ensuring that they do so under conditions of equality.
The draft Order has already gone through the pre-consultation process, between 3 and 31 October. In this new phase of public hearing, the text of the draft Order is made available to the citizens affected and to the entities interested inThis web page, to obtain as many additional contributions as may be made. Adaptation of times and means
The text of the draft Order updates and improves the adaptation and adjustment measures established in the selective processes for access to public employment almost two decades ago, following the approval of Royal Decree 2271/2004. It deals with the adaptation of times (the granting of additional time for the realization of the exercises), of means (making available material and human means for the realization of the tests, and guarantee of the accessibility to the information and communication of the processes) and reasonable adjustments (the adaptations required by the specific situations of the applicants with disabilities that cannot be solved with the generic adaptations of times and means).
In this sense, the adaptations of human resources may consist, if appropriate, according to the draft Order, in the use by the applicant with disabilities of a personal assistant or work preparation, a sign language interpreter, a guide-interpreter (for deaf-blind persons) or other assistance or support staff.
The time adaptations are arranged according to the type and degree of disability according to a range of criteria included in the text itself, which will allow the selection bodies to decide the additional time for the test with which the applicants will have the opportunity to apply.
The text of the draft Order also defines the process by which the selection bodies will be able to assess and decide on the requests for adaptation of means, times and other reasonable adjustments of the applicants, including the cases not provided for in the standard, which will be resolved in accordance with the principles of legality, proportionality and equity, and always in the most favourable way to guarantee equal opportunities.
The draft Order is part of the initiatives that the Government of Spain is taking to achieve a more inclusive public employment, among which is the reservation in the Public Employment Offer of 2024 of a 10% quota of places for people with disabilities.
The Ministry of Social Rights, Consumption and Agenda 2030 points out that this Order reinforces the commitment of the Government of Spain with the employment activation of people with disabilities, not only from the access to employment but for their stay as officials and officials, while ensuring their well-being and inclusion in the work environment and good professional performance. For this reason, they point out from Social Rights, in this legislature labor inclusion units have been created that will be incorporated into each ministry. Likewise, they emphasize, the measures contemplated in the White Paper “Employment and Disability” will be deployed so that the new labour market, digitalized, globalized and highly competitive, does not expel people with disabilities and offers them stability and labour rights.
