The Digital Rights Charter is subject to public consultation

From the Ministry of Economic Affairs and Digital Transformation, the Spanish Digital Bill of Rights has been elaborated, one of the fundamental commitments of the Spain Digital 2025 plan. There have been many contributions from civil society in the process, as well as the work of a group of first-level experts. The draft Charter is now subject to public consultation, open until 4 December.

The Digital Rights Charter aims to recognise the challenges of adapting existing rights to the virtual environment, and to propose a reference framework to contribute to their protection in this context. To this end, the Secretary of State for Digitization and Artificial Intelligence, belonging to the Ministry of Economic Affairs and Digital Transformation, launched a broad public consultation process and has promoted the work of a group of experts in the field consisting of prominent jurists, user representatives and internauts or cybersecurity consultants, among other profiles, with the participation of the ministries of Justice and Presidency, Relations with the Spanish Agency.

As a result of this work, the text submitted to public consultation contains a set of principles and rights to guide future policy projects and the development of public policies in a way that ensures the protection of individual and collective rights in the new digital scenarios.

Recognition of the right to equality in digital environments, non-discrimination and non-exclusion are relevant. In addition, the gender perspective will be applied in the digital transformation procedures. Public authorities will promote policies aimed at the effective access of all people to the services and opportunities offered by digital environments in any of their dimensions and will combat digital gaps in all their manifestations.

After the comments and contributions made at this stage of public consultation, the final text of the Digital Rights Charter will be drawn up, which will inspire the future steps to be taken in protecting society in the face of the new digital challenges, setting out the principles on which to safeguard fundamental rights in the digital scenario.

With this proposal for a Charter, Spain wishes to remain in an international leading position in the protection of citizens' rights and to contribute actively to the various initiatives and debates that are taking place at European and global level.
