Applicable rules

• Article 20.1.h) of Law 30/1984 of 2 August on Measures for the Reform of the Civil Service.
• Resolution of 29 March 2019 of the Secretariat of State for Civil Service, laying down the rules applicable to the granting of transfers to career officials of the General Administration of the State for reasons of disability or aggravation of the degree of disability, as well as for health reasons and rehabilitation possibilities for career officials, their spouses or their dependent sons and daughters.

Procedure and competent bodies

The person concerned shall make a written request to the Unit with responsibility for staff of the Ministry, Government Delegation or Agency in which it is intended.

To this end, the model of the Annex accompanying the Resolution of 29 March 2019.

This request shall be accompanied by the supporting documentation of the need for relocation described in the Resolution of 29 March 2019.

Once the circumstances for this type of mobility have been established, the competent body shall initiate the procedure.

In the exceptional case that the Ministry or Agency of origin does not have dependencies in a geographical area appropriate to the geophysical and environmental conditions of the applicant, this fact shall be brought to the attention of the Directorate General of the Civil Service, which shall process the procedure in these cases.

The decision of the procedure shall be taken by the Staff Authority of the Department or Body in which the applicant is appointed.

If the transfer is made to a post under a Ministerial Department other than the one in which the applicant is appointed, the decision shall be issued by the Directorate-General for Civil Service, by delegation of the Secretariat of State for Civil Service.

Deadline for Resolution

The maximum period for giving a decision shall be 3 months, unless mobility requires the creation, modification or deconcentration of a post, in which case the period of resolution may be 6 months.
