Implementing rules
The situation of destination expectation is regulated in:
- Article 29.5 of Act 30/1984 on measures for the reform of the civil service
- Article 12 of Royal Decree 365/1995 on administrative situations
Assumptions and requirements
Career officials affected by a reassignment procedure for those who have not been employed in the first two phases shall be declared on assignment.
Officials expected to serve will be assigned to the Ministry of Finance and Public Service, through specific relationships of posts in reallocation, and may be redeployed by the Ministry.
Characteristics of the situation
- Staff members shall remain in this situation for a maximum period of one year, after which they shall return to the situation of forced leave.
- Staff members in a position of expectation of employment shall be required to accept positions of similar characteristics to those offered to them in the province where they were intended; to participate in competitions for the provision of jobs appropriate to their Corps, Scale or Category, which are notified to them, located in those provinces of destination, and to participate in the training courses to which they are invited, promoted or conducted by the National Institute of National Administration.
- For the purposes of the preceding paragraph, posts of similar characteristics shall be those which are similar in their form of provision and remuneration in respect of which they were held.
- Failure to comply with these obligations will determine the transition to forced leave.
- Staff members expected to be paid basic salaries, allowances and 50 per cent of their specific post complement.
