Exchange of vacancies reserved for local administration officials with national qualifications

Any person interested in the swap, with the agreement of the other, may apply for the authorisation of job losses to local government officials with a national qualification, where this exceeds the territorial scope of an Autonomous Community.

Requirements:

  • The jobs to be lost must be of the same nature and form of provision.
  • Persons intending to swap must have, respectively, a number of years of service which does not differ by more than five.

Conditioners:

  • Within 10 years of the granting of a swap, any interested party may not be authorised.
  • No exchange between civil servants may be permitted where a staff member is less than ten years away from the age of forced retirement.
  • Swaps shall be cancelled if within two years of the date on which the voluntary retirement of one of the permutants takes place.

RULES OF PROCEDURE

It is governed, inter alia, by Article 27 of the Royal Decree 128/2018, of 16 March, regulating the legal regime of Local Government officials with national qualifications.

Documentation to be provided

Without prejudice to the need for additional documentation, the submission of:

  • Conformity of the persons concerned.
  • Conformity of their Local Entities of destination.
