Retirements and prolongations of the active service of local administration staff with national qualifications (FHCN)
The Marketing Authorisation Holder local authorities providing (or providing) services to such personnel must transfer to this Ministry both retirements (including permanent incapacity retirements) and prolongations of the active service of this kind of staff, for the purposes of their registration in the integrated FHCN register as soon as possible and in order that the place occupied by the FHCN is or is not considered vacant, as appropriate, for the purpose of forecasting places to be offered.
For this purpose, both procedures have been set up at the e-Office of Public Administrations and the documentation to be submitted is described below:
NOTIFICATION OF FHCN PENSIONS (INCLUDING PERMANENT INCAPACITIES)
The age of forced retirement of civil servants included in the general social security scheme, in which the FHCN is located, shall be that provided for by the rules governing access to the pension in its contributory form without an age-reducing coefficient. At that age, and unless extended stay in active employment has been granted, the FHCN will lose its status as a career official for retirement.
In any case, the FHCN must be retired at the age of 70.
Local authorities should notify the retirements of their FHCN, as soon as they occur, through the electronic headquarters of this Ministry, using the procedure known as “Registration of Local Government Staff Retirements with National Qualifications”, which is provided in the section “Means of Presentation”, by submitting the following documentation:
- Mayor's Decree declaring retirement
- In the event that the decree is dated prior to the date on which the retirement takes place, documentary evidence of retirement will be provided (TGSS Effective Cessation/Discontinuance Act).
This procedure shall also apply to retirements on declaration of permanent incapacity, in which case the documentation to be submitted shall be as follows:
- Mayor's Decree declaring retirement due to permanent incapacity.
- INSS resolution declaring permanent incapacity.
NOTIFICATION OF EXTENSIONS TO THE FHCN ACTIVE SERVICE
The age of forced retirement of civil servants included in the general social security scheme, in which the FHCN is located, shall be that provided for by the rules governing access to the pension in its contributory form without an age-reducing coefficient. However, the staff member may request the Administration in which he/she provides services to extend his/her stay in active service up to the age of seventy.
This procedure provides for the registration of the extension of the stay in active service of Local Administration Officers with a national qualification.
Local authorities should communicate the extensions of the active service of their FHCN, as soon as they are granted, through the electronic headquarters of this Ministry, using the procedure known as “Registration of the extension of the active service of Local Administration staff with a national qualification”, which is provided in the section “Means of Presentation”, presenting the following documentation:
- Decree of the competent body accepting the extension of the active service requested by the official
This active service extension shall be valid for a maximum of 70 years on the day the FHCN is 70.
NOTE: In the event of the retirement of staff in the extension of active service, this shall be notified in accordance with the provisions of the preceding paragraph (FHCN Retirement Notification).
MEANS OF PRESENTATION (ACCESS)
Applications for registration will be submitted via the website of the electronic headquarters of Public Administrations, for which a valid means of identification and electronic signature will have to be in possession.
