Exchange of posts between career officials
It is about the exchange of posts between two officials or officials.
Existing legislation
Article 62 of the Articulated Law on Civil Servants of the State, approved by Decree 315/1964 of 7 February.
Requirements for authorisation
- The posts to be cut must be of the same nature, identical at all ends
- The posts to be lost must have the same form of provision.
- Officials seeking the exchange must have a number of years of service which do not differ from each other more than five
- Within 10 years of the granting of a swap, no other authorisation may be granted to any interested party.
- No exchange between officials may be permitted if one of them is less than ten years short of the compulsory retirement age.
- Swaps shall be cancelled if the voluntary retirement of one of the permutants occurs within two years of their authorisation.
Authority competent to authorise it
Directorate General of the Civil Service.
Procedure
It starts at the request of the two people interested in changing their posts. Your requests should be addressed to the ministries in which each of them is intended, with a copy of the request of the person with whom you wish to permute.
Each Ministry shall issue a report on its opinion in relation to the requested swap.
If the report is favourable, each of them shall forward to the Directorate-General for the Civil Service all the documentation necessary for the decision by this management body, including both the report in favour of the exchange and a report for the verification by the Directorate-General for the Civil Service of the other requirements that this procedure requires.
The Directorate-General for Civil Service shall issue the relevant Decision, which shall terminate the procedure.
Deadline for resolution
The time limit for the resolution of this procedure is three months, calculated from the date on which the dossier is entered in the register of the body competent for its resolution.
