LEAVE FOR FAMILY CARE
Career officials shall be entitled to a period of leave of not more than three years to care for each child, whether by nature or by adoption, or for each child subject to custody for adoption or permanent reception, starting from the date of birth or, where appropriate, from the judicial or administrative decision.
They shall also be entitled to a period of leave of not more than three years in order to care for a dependant family member up to and including the second degree of consanguinity or affinity which, for reasons of age, accident, illness or disability, cannot be self-employed and does not engage in gainful activity.
The period of leave of absence shall be unique for each causative person. Where a new cause gives rise to a new leave, the beginning of the leave period shall put an end to the person who has been enjoying it.
Where two officials create the right to enjoy it by the same causative person, the Administration may limit its simultaneous exercise for justified reasons relating to the operation of the services.
Documentation to be submitted
For leave for childcare:
Unless you do. show its express and reasoned opposition, the Administration shall consult on its own initiative:
- Certificate of birth of the child.
However, if the link is for adoption or pre-adoptive reception, it must provide the supporting documentation of this circumstance. In addition, if you have objected to the consultation, you must provide a copy of the birth certificate, the family book or official document certifying the members of the family unit.
In all cases they must provide:
- Affidavit of the applicant not to perform any other activity that impairs the care of the child.
- Affidavit of the couple not being in the situation of leave for care of relatives for the same causative fact.
- Letter from the Administration of destination stating that they have been informed that an application for leave will be made to the competent unit of the Ministry of Finance and Civil Service.
For leave for the care of family members:
- Documentation demonstrating the kinship relationship up to and including the second degree of consanguinity or affinity.
- Authorization for the processing of your personal data signed by the family member. (Authorisation model for the processing of personal data)
- Affidavit of the applicant not to perform any other activity which impairs the care of the family member, as well as of the family member not to perform gainful activity.
- Letter from the Administration of destination stating that they have been informed that an application for leave will be made to the competent unit of the Ministry of Finance and Civil Service.
- Where appropriate, resolution of recognition of the situation of dependency/disability by the competent Administration.
- Medical report certifying that the family member cannot stand for himself.
- Certificate of dependant not to be discharged from any of the social security schemes.
- Responsible statement of the dependent person who is not gainfully employed.
- Responsible statement by the applicant that there is no other official in this situation by the same causative person.
