Approval of contests
Applicable rules
- Article 79 of Royal Legislative Decree 5/2015, of 30 October, approving the recast text of the Law on the Basic Status of the Public Employee.
- Article 20 of Law 30/1984 of 2 August 1984 on measures for the reform of the Civil Service.
- Articles 39 et seq. of Royal Decree 364/1995 of 10 March.
Common bases for merit contests
The common bases were approved by the Director-General for Civil Service at the 29 September 2022, being of mandatory application from 1 October 2022.
In certain merit contests involving special bodies or scales, the Directorate-General for Function may authorise certain modifications to the common bases.
Procedure and competent bodies
Each Ministry or Convening Body must submit to the Directorate-General for Civil Service the project for the award of the competition.
Once all the necessary documents have been received, the Secretariat of State for Civil Service shall issue the required authorization prior to the call for tenders, which shall contain, where appropriate, comments on the project for the call under analysis.
The approval of the call for competition will then be forwarded to the Ministry or Agency that had applied for it, taking over from that point on all the proceedings relating to the authorised tender.
The Ministry or Agency shall adapt the draft notice to the comments contained in the authorization issued by the Secretariat of State for Civil Service.
Once the appropriate modifications have been made, the person who holds the Subsecretariat, in the case of Ministerial Departments, or the person who has conferred this competence, in the case of Public Bodies, shall sign the Decision to convene the competition for merits.
Finally, the call for competition will be sent to the Official State Gazette for publication.
Deadline for Resolution
In accordance with the common bases, the maximum time limit for the resolution of each invitation to tender shall be 6 months.
