- The aim is to bring this regulation into line with the European Directive adopted in 2024 in order to avoid disruptions to the EU’s internal market in crisis cases.
The European Parliament approved Directive (EU) 2024/2749 with the aim of ensuring that a crisis, such as that caused by the COVID pandemic, does not disrupt the normal functioning of the internal market of the European Union; does not affect the free movement of goods, services and people; and that the availability of goods and services of critical importance to citizens is guaranteed.
The European Directive makes it necessary to amend the Regulation laying down the requirements for the placing on the market, putting into service and use of radio equipment. The consultation, which will be open until March 10, is the first step to the processing of a draft Royal Decree incorporating the necessary amendments.
The aim is that the new regulation should include:
− Emergency procedures to ensure that, during an emergency mode of the internal market, goods relevant to harmonised crises can be rapidly placed on the market.
− The requirement that conformity assessment bodies give priority to applications for conformity assessment of goods that have been designated as crisis-relevant goods.
- The possibility for the competent authorities, on an exceptional and temporary basis, in the context of an ongoing internal market emergency, to authorise the introduction into the internal market of products which have not been subjected to the usual conformity assessment procedures, provided that the applicable essential safety requirements are guaranteed.
- Mechanisms for the provision of technical references, where an internal market emergency leads to an exponential increase in demand for certain products, which manufacturers should be able to use to design and produce crisis-relevant goods that meet the applicable essential health and safety requirements.
− Emergency procedures in the event of a crisis affecting the functioning of the internal market.
